For those of you whose dispute was challenged by Stormpay :

If you have a valid dispute with them, that is, you are only attempting to get your money back from a program that you made no profit from, then take the following advice:

Listen, SP will challenge your disputes. It is pretty much an automatic (SP's hope is that you will just give-up at their first contestment). But their contestment is only one step in a series of steps within the dispute process. Visa, Mastercard, and your bank, are very familiar with the process. Here is the process:

Dispute Steps (Summary Handout)

The High Level Steps in the Dispute Process:

1) The Cardholder/Bank Account Holder reports the dispute.
2) The Dispute Analyst reviews the request and either places the charge in Dispute, or denies the request.
If the dispute seems valid and is under the write-off limit, the Dispute Analyst has permission to write it
off.
3) N/A
4) N/A
5) A Chargeback is requested by the Dispute Analyst (a "Provisional Credit" is issued in the mean
time.
6) The Merchant can request a Representment if they disagree with the Chargeback. If they
agree with the Chargeback, they issue the credit. This is where you are at right now, bietddiveddau. A
Representment is when the money is taken back.


bietddiveddau, your job now is to get your Dispute Analyst to do a "Second Chargeback" (see how to do this below).

7) The Dispute Analyst can request a Second Chargeback if they still don�€™t agree with the charge.
8) The Merchant can request Prearbitration if they still don�€™t agree with the charge.
9) If the Dispute Analyst has enough documentation and facts, they will disagree with the prearbitration.
10) The Merchant decides whether or not to enter into Arbitration. This costs filing fees ($150) and technical fees ($100 per technicality).

Okay. So with me, SP already contested my dispute and has requested a "Representment". You have to be ready to convince your Dispute Analyst to do a Second Chargeback. You do this by submitting extra, and more concise information on what SP did, and didn't do.

As part of that information inform your Dispute Analyst the following:

surname here (Dispute Representative/Analyst): Since a Representment by the merchant has been initiated, if necessary, and upon your concurrence, it is my desire that a Second Chargeback be done. Ultimately, I am willing to wait as long a takes, even if the merchant chooses Prearbitartion and on through to the Arbitration phase where a neutral third party will hear facts from both sides.

*Accordining to the SEC's Kelly Bowers (Click Here) SP continues to hold your funds today, and, the latest March 27th "Civil Minutes" Order reinstated your right to file a dispute under applicable laws and regulations, including without limitation, the Electronic Funds Transfer Act, Federal Reserve Regulation E, the Truth in Lending Act and Regulation Z, and applicable ACH rules, including the NACHA Rules and Federal Reserve Bank Operating Circular 4. My filed dispute with Stormpay.com is based on a breach of these applicable laws.

Always remember the basis for your dispute, and, at all times, keep that basis foremost in the mind of the Dispute Analyst. Don't get lost in the details. Here is the concise basis of your dispute (not necessarily in this order):

1) "Services Not Rendered": Failure to deliver service agreed upon.

Example: You "authorized": $1 to SP - SP to 3rd party (same $1) - 3rd party to SP (same $1) (It was at this point where SP interfered with the return of, and intercepted that same $1). - SP to you.

2) Money Transmitter License: Was conducting business in your state (country?) illegally, and in violation of their 2003 Cease & Desist Order.

3) "Unauthorized Use": Applicable Laws i.e. Regulation E: Interfered and intercepted your money.

4) Deceptive Practice: Stormpay & NetIBA (and, may be considered fraud).

For whatever reason you give to the Dispute Analyst, s/he has to in turn, match that reason up to a certain code. One of the four reasons given above should match one of her/his codes.

When or if your "Provisional Credit" is taken back, say to the Dispute Analyst, "Doesn't any of your codes match any of the four bases for my dispute?

BTW, so you get an idea of the dispute time frame, here it is:

I have already submitted my paper work for my second charge back last friday. I called MBNA today and I was told that my dispute was submitted and now there is nothing to do but wait to see if scampay will respond back within 45 days. If they do not respond back i will get my money credit back. But wat happens if they do respond? Is this how a second charge back works? They dont issue provisional credit for the second charge back.

Has anyone tried getting an extension of time to further the dispute?

doesn't make cense, I send 1 page explaining my dispute and SP had 45 days to reply. SP sends me around 30 pages for their dispute and I have 1 week to dispute theirs. thumbdown.gif

Thanks Helper1. This is very good info. I just received reversal of my chargeback from my bank. I will initiate the second chargeback. SP use the user agreement and transaction record as a dispute to my first chargeback. What a lame excuse.

Thanks Helper1 ... I got the docs!

Does anyone know if Stormpay created Chargebacks for Charis Johnson, or for that matter when I received my account history in the mail, a whole host of other companies that i am sure did not do chargebacks from me. I am currently suspended from my SP account, but to my suprise I have a positive balance after about 10 chargebacks from random people, but I cannot get to the money.

Has this happened to anyone else, and what I can I do to have stormpay re-open my account so that I can see my transactions, or how can I use this in my favor?

Don't take this the wrong way, I am not a fan of Stormpay but when it comes to chargebacks I have a question.

But first let me show you my logic so you can agree or disagree.

1. You fund a payment processor account with a credit card.
2. You use those funds to purchase advertising at your favorite autosurf site (or any other MLM, surf, or money making site.)
3. The surf site gives you your advertising. Whether you use it or not is not really an issue because the surf site or other ad based money making site probably comes with a no refund policy.
4. Chances are the Surf/MLM/ etc site doesn't actually guarantee you will earn any money.

So you paid for advertising and received it but didn't earn any income.

Forget about Stormpay for a second and explain why the above sentence is justification for a chargeback?

To me it sounds like you put money down at a blackjack table and lost, then you are asking the casino for your money back because you did not profit.

I am most likely wrong but I am having trouble understanding, unless of course the Stormpay chargeback war is strictly waged as a vendetta, regardless of the ads (product/service) that were received.

Of course all of the above assumes that companies like 12dp actually give you something when you pay them. Not being a member I cannot say for sure.

I felt the same way as you before Stormpay, I never justified doing chargebacks on any gamble/investments I've made in the past.

However, chargebacks against stormpay is very justifiable. They failed to act legally as a money tranmitter sevice, which I entrusted them to do for me.

Helper1 - I can't see the docs in your signature (it wants me to sign up for some yahoo thing..), and I'd really like to get those documents, can you send them to freeipod@team-nin.com please? (it's a 'junk mail' black hole, but I check it every other day for relevant emails).



Quick story on my chargeback background, I put in over $1k the last week of January, after 2 1/2 months of successfully using 12dailypro, and then SP locked 'em down the very next day (just my luck..). Due to all the problems that happened, and my 'faith' in 12dp fixing the problems, I didn't file any chargebacks until late March, early April - when I found out that Visa/MC had reversed the feds order of 'no chargebacks' 8), and I managed to re-acquire my funds (I had used a debit card hooked with my local bank).

The day after the funds were transferred back into my bank account (knowing what SP was going to do), I withdrew all my money and closed the bank account, then opened a new account at another bank entirely.
About a week and a half ago I got a packet in the mail from my old bank with about 70 pages in it, all pertaining to them simply saying, "SP says you owe them money, and have refuted the chargeback. Come pay us at your earliest convenience please".

Honestly I had half a mind to ignore them, but I knew it had to be handled, so I came across this page while suring the net and found the information you did post publicly to be extremely informative, then I read how well your documents are assisting (and have assisted) other people, so I am hoping that I can get rid of this problem with what your documents show.


BTW on another note (I haven't browsed the forums here yet, so don't know if it's even posted) but SP is no longer an online payment processor (the renewal on their license was refused! biggrin.gif That's why they are only an auction site now smile.gif.), so do they LEGALLY have a claim to any 'back money', considering they can't even process it anymore?

Was just wondering if that could (or is) a major thing to point out to these banks/CC companies now...

Unfortunately, the documentation that I need to pursue a second chargeback is contained within my Stormpay account records, which I cannot access because my account is suspended. Yes, I know that I should have printed them out before the first chargeback, but hinesight is 20/20.

So the question is.....

Do I have a right to request my account history from Stormpay, and are they obligated to provide me with such information. Or, can they just tell me to go take a flying leap?
