EMOcorp, a highly respected, law abiding company that is being hassles by the government because they claim EMOcorp didnt have the right paperwork. Fine! Just give them a fine, make them pay, fillout the paperwork and be on your merry way. However, the government is lying to you, me, and the whole world. The claim EMO has a "certain amount" of money missing, some have said 1mil, some have said 2-3 mil. This simply doesn't add up when we still hear and read emails from people who worked for EMOcorp, who said the money IS NOT MISSING, its there, plain as day. Crazy facts being thrown around here.
Now, say all this is true. Say EMOcorp is not showing a certain amount of money. Make them sell off assests to pay the bills. I didn't know EMOcorp was in a bind for money anyways. You can file a motion with the court that has jurisdiction over the case. Good luck.
How long can they hold the funds? The short answer is: until they sort everything out and figure exactly how much money is customer money and how much in liquid assets EMO has. If the amount of money that is a liability to EMO(customer money) is greater than what EMO has and EMO doesn't have a way to make up the difference, the receiver will most likely sell all assets EMO has. If that's still not enough, it gets cloudy as to what might happen. Receiver may issue partial refunds until funds are depleted and seek the rest through civil action against EMO owners, go back to the court and ask for direction, etc.
What the receiver is LIKELY doing now is finding out where all the EMO money is. There are 3 banks listed in the court action, so that's where probably the bulk of it is. I know EMO got stiffed badly by intgold......that makes things complicated. Then there is StormPay. It gets to be something that isn't simple to figure out and will take time.

I agree totally with what you have said. The whole process is inaccurate. EMO is forbidden to get at its records to prove the inaccuracies or contact its loyal customers. The Department of Banking is wrong on this one. EMO is fighting for all it's worth for its employees and customers. Seeing how the business and personal assests are frozen it is difficult to do on a wing and a prayer. When the public gets at the truth the state of Texas will have egg on it's face. Remember it is an election year, and you all have the power when you pull that lever. Anyone can help by calling, writing or e-mailing the Govenor- Rick Perry, Senator Barrientos, House Representative Donna Howard and or Russell James the Banking Commissioner. U.S. Chamber Study Cites Worst States for Legal Fairness West Virginia Ranks Last, Mississippi Moving in Right Direction
WASHINGTON, DC—West Virginia, Louisiana, Illinois, California, and Texas were among the worst states for legal fairness, while Mississippi is improving after enacting legal reforms, according to a new ranking of the best and worst state legal systems released today by the U.S. Chamber Institute for Legal Reform (ILR).
"This survey sends a clear message to states whose legal climate drives away businesses, jobs, and economic development," said Tom Donohue, president and CEO of the U.S. Chamber of Commerce. "If you want a healthy state economy, clean up your act."
The study found the five top states for overall legal fairness are, in order, Delaware, Nebraska, Virginia, Iowa, and Connecticut. "Businesses go where they are welcome," said Donohue. "One of the most welcoming features of a state is a fair legal system. When businesses set up shop in your state, they bring jobs, an expanded tax base, and economic vitality."
The 2006 State Liability Systems Ranking Study was conducted by Harris Interactive for ILR. The survey, now in its fifth year, polled more than 1,400 senior attorneys to explore how reasonable and fair the tort liability system is perceived to be by U.S. businesses. The attorneys were asked to judge a number of factors, including overall treatment of tort and contract litigation, treatment of class action suits and mass consolidation suits, judges' impartiality and competence, and juries' predictability and fairness.
ILR is launching a national advertising campaign highlighting the results of the study and the need for comprehensive legal reform. The print campaign will feature the message "Please Don't Feed the Trial Lawyers."

EMO isn't fighting anything. Read their latest court update on EMO's site. They have given up totally and are now at the mercy of the receiver and the court.

do not waste your time here -- stand for emo, read these articles, follow up, and call these great offices, and let them know what you think of how "great" texas is for business.

I've had an EMO acct since EMO started in business. I'm "negative" on EMO surviving because they have already signed a consent order and everything they own is now in the hands of a court-appointed receiver, AS THE EMO OWNERS AGREED TO. It's dead and it will be months at minimum before EMO customers see a dime back and then it wil be pennies on the dollar.
