I have an $18,000+ chargeback with stormpay via Bank of America Credit company.

It has been provisional credit for some time, but now stormpay responded, stating that I accepted the terms of agreement, etc, etc. They also show 3 deposits to my bank account prior to think going haywire, this was January.

What should I say in response, to BofA the overnighted the forms to me so I get back to them ASAP about this with documentation and evidence that they stole my money.

I said they cooked the books, I have no proof
They zeroed my account- I have no proof
The closed my account- have proof

Issue is stormpay says I transfered this money out of their system, when in fact the money was sitting in my stormpay account.

Any advise would be very helpfull! Thanks. ohmy.gif

What State are you in?

Make sure you send them the link to their BBB report:

http://data.middletennessee.bbb.org/common...tml?bid=2146166

Also let them know that thousands of other people are filing merchant disputes against SP. BOA can look some of this stuff up.

It was a good idea for you to state how everything has been destroyed on SP's end. Also explain to them how their TOS was changing daily.

Let them know you sent money to them with the intentions it would be going to a merchant and you would be receiving money back from the merchants, but SP froze the merchants account and suspended yours. Now there is no way of receiving your money. Indicate that you have tried emailing SP but no response.

Here's another link you can add:

Also, take note of ScamPay and how they are not permitted to be a money transmitter in your state, and how they are scrambling to comply only now, although because they took your money in the past they are in clear violation.

I've had the same thing going on with Stormpay and Chase.

Chase gave me a credit.....took that back then reissued the credit a few days later.

Did BOA just issue you provisional credit or is it permanent now?

We need to start posting some of the info we've used in our letters for chargebacks as well as disputing SP's counter-claims on our chargebacks. This way we all have more ammo than just what we intended to send. I have listed a few things above in this thread.

Please, everyone who has issued chargebacks, list the facts you sent or copy and paste the letter you sent to get your chargeback issued from your banks.

Thank you for all yhe answers but i would like to know too if the chargebacks that everyone says they got are permanent or temporary... I got a temporary credit but i have to wait for BoA to finish there investigating before it will be permanent credit pending what they find out. I told Bank of America that I was going to use Stormpay to pay a merchant and that Stormpay never got the money to the merchant and when I tried to contact them they did not respond so I had no idea what happened to my money. I had just put money in 12dailypro for the first time right before all hell broke loose so as far as I know they didnt ever transfer the money... I did not tell the bank who i was sendin the money too only that Stormpay stole my money... I should know by mid April if I am going to get to keep the chargeback...

Thanks for your replies everyone!

I prepared the letter for BofA and faxed it today with all of the supporting documents that everyone helped ,me with here.

I have a permanent credit from Capital One --$7,000.00 ; CitiBank- $2,000.00 and MBNA for $9,000.00

I now have $18,000.00 Pending with Bank of America due to the stormpay response. I have all supporting documents, but stormpay is lying- they said I am trying to take advantage of the chargeback system! Beleive that, just because I had received 3 small ach deposits to my bank account, and they said I am charging back more then I deposited.

They are such liars, I really wish the FTC would be on our side not in bed with stormpay over all this.

I'll post an update once I hear from my bank, will probably be some time. (2 weeks usually)

thorvat1, i'm in the same situation as you, i have filed a chargeback with BOA from 2000, i'm currently on temporary credit. good luck man.

Well if everyone is filing all these chargebacks on Stormpay hopefully all finacial institutes will look at this and realize Stormpay is majorily at fault and give us no trouble... Glad to hear people are getting permanent credits from there chargebacks.

I will never again use Stormpay all the stuff I am reading about them I really don't know how there still running... Good luck to everyone

I am also hoping that the "word-of-mouth" spreads throughout the banking institutions, and it becomes clear-cut and simple to issue permanent chargebacks to people. I think another good thing to include in our letters is to refer to other creditors issuing permanent chargebacks to people. For instance, if writing to BOA, let them know that you have heard people getting permanent chargebacks already from Chase, MBNA, etc. I actually did this in my letter also.

Hey man, I hope you succeed. I also have a BoA account and thought of doing the same, but wondered how it would end up. You know, I hate legal rambling sad.gif

I'm the one who started the thread entitled, "NEW- What to do when SP responds to your chargeback!".

I've received some Private Messages (PM's) from some of you asking for help. So, I have prepared an email that corresponds to my response to Stormpay's contestment of my first chargeback.

I urge all of you to get it as I think that you will find it very useful. It includes a pdf file that I sent to my Dispute Analyst regarding SP's past and recent history (all the bad things you've come to know about). This is not to malign stormpay (don't take that stance, truth speaks for itself), but their credibility is very relevant to your case. This will help to get your Dispute Analyst on your side.

If you want the email, just PM me and leave me your email address and I'll send it to you.

We all know there are Stormpay posers ("plants") on various forums, please do not share any of the dispute information that I share with you by posting it on an open forum, or by forwarding it to others via email. If anyone asks you for it just PM me (or have them PM me) and I'll send it directly to them. You don't want to jeopardize yours and everyone elses dispute by giving SP advance notice on what's coming their way.

I suggest give it a shot too.....Those who can risk their money into HYIP's why not use these 60 days for a gamble where you might end up getting all your money back to where it belong......Worth to try biggrin.gif
