I see that Amazon are having to close down Associates accounts for those living in North Carolina.

Here is notification of what they intend doing when/if the time comes.

We regret to inform you that the North Carolina state legislature (the General Assembly) appears ready to enact an unconstitutional tax collection scheme that would leave Amazon.com little choice but to end its relationships with North Carolina-based Associates. You are receiving this e-mail because our records indicate that you are an Amazon Associate and resident of North Carolina.

Please note that this is not an immediate termination notice and you are still a valued participant in the Associates Program. All referral fees earned on qualified traffic will continue to be paid as planned.

But because the new law is drafted to go into effect once enacted – which could happen in the next two weeks – we will have to terminate the participation of all North Carolina residents in the Amazon Associates program on or before that same day. After the termination day, we will no longer pay any referral fees for customers referred to Amazon.com or Endless.com nor will we accept new applications for the Associates program from North Carolina residents.

The unfortunate consequences of this legislation on North Carolina residents like you were explained in detail to key senators and representatives in Raleigh, including the leadership of the Senate, House, and both chambers’ finance committees. Other states, including Maryland, Minnesota, and Tennessee, considered nearly identical schemes, but rejected these proposals largely because of the adverse impact on their states’ residents.

Out of interest this was also tried in New York. The `extension` of a company to its affiliates sounds crazy! rolleyes.gif

Because Overstock has a number of affiliates in New York, it is considered (through some very creative logic) to be physically in the state too, which means that it has to collect taxes from all NY customers.

Amazon threatens to cut off NC associates if state tax bill passes

RALEIGH, NC - Amazon.com says that if a new North Carolina tax bill on "click-through" transactions becomes law, it will cut off its associates in the state.

Amazon associates receive up to 15 percent commissions on sales made via click-throughs on their sites.

In a June 17 letter to its NC associates, Amazon wrote:

"We regret to inform you that the North Carolina state legislature (the General Assembly) appears ready to enact an unconstitutional tax collection scheme that would leave Amazon.com little choice but to end its relationships with North Carolina-based Associates."

Like many states, North Carolina is struggling with a declining tax base and budget shortfalls due to the recession. It is considering a number of new taxes to help meet the shortfall.

In its letter, Amazon said that because the law is drafted to go into effect as soon as it is enacted, which could be in as little as two weeks, the company would terminate its associates in the state before or on the same day as it goes into effect.

Amazon wrote:

Just been reading that Amazon has sent a letter to California politicians, including Governor Arnold Schwarzenegger, to respectfully ask that California doesn`t go the way of N.C.

If California does, then Amazon has made it clear they will remove all Associates from their program.

Just been reading that Amazon has removed affiliates in N. Carolina, Hawaii, and now Rhode Island from its program.

Amazon has closed NC and RI accounts. I live in NC. Received an email from Amazon stating my account had been closed due to unconstitutional tax laws about to be passed here. I didn't even know anything about the new legislation that was coming until I received this email. Shows how they're trying to keep it under wraps.

I've signed a few petitions against the legislation. Hoping these decisions will be reversed. It's affected a couple other affiliate programs for NC residents as well.
