The worst thing for me is that I upgraded from pendings to e-gold & I've 3 pending payouts which I can't get refunds nor can I do a chargeback. Just lost them all.

The Facts: Anyone that ever signed up for a Stormpay at any time was taken to a signup page that required them to signup for an account with their personal name. There was no option to create a merchant account. Then when you entered that account there was another page that allowed you to add and link bank accounts to that personal account. There was a clear warning that stated that you could only link bank accounts that matched the name on the account. StormPay at no time during my personal association with them had a merchant account option. Thus any funds withdrawn would be withdrawn to a personal account. From that personal account one could then transfer funds as needed into a business account, pay for business expenses, or transfer money to other payment processors for instance. 1.9 million was all the money that I personally withdrew from StormPay throughout my entire personal relationship with them, which began in May of 2005. Bank documentation proves that almost 1.4 million dollars of that was transferred into another payment processor and server files prove that that money was used to pay members of my former company. Bank documentation also proves that the remainder of the funds were used for rent, operational, salary, and technology expenses associated with my former company, which employed 12 people. If you break that down, its a miniscule pitance compared to the amount of money that members of my former company earned over the course of 9 months. The Falsehood: I am getting $5000 a month from the SEC and my attorney is getting $10,000 a month from the SEC which is coming from money intended for refunds. The Truth: The $5000 a month I am received is coming directly from my own personal bank accounts which were frozen. This money includes the life savings of myself and my husband as well as salary he received from his employer which had nothing to do with my former company. So we are not being given anybody's money but our own. And my attorney has not received a dime from the SEC and won't unless another party sees fit to give up the money they continue to hold. As well, the $10,000 is meant to be a one time payment if and when it occurs, not a monthly payment. These payments only come at all because I was never legally charged with any wrong doing and I formally neither admitted nor denied any of the allegations in the original complaint. The Falsehood: I have people's money and can get them their refunds. The Truth: The SEC has taken control of all assets of my former company. I have been completely and totally cooperative and have given the SEC everything they have asked for. There was a company that said they froze funds of my former company so they could be given as refunds. The question people need to be asking is if this company has been as cooperative as I have and if they have indeed turned over these funds as they claimed they were going to. I personally chose the path that I did so that any money available would be immediately deemed to be monies belonging to the members of my former company and could be gotten from that payment processor and be refunded. At that moment, I ceased to have any control over how and if that will occur nor do I know what the company that froze the funds has done since with the money they claimed to have in their posession. As you read abut my chargebacks, Chase didnt do any chargebacks till just a couple days ago(it's been about 60 days since I sent them my info) so I think it's a done deal there. As for Bank of america, they did my chargeback in feb the same day I called them and said when things came up they would need info on stormpay..If my info doesnt pan out, they will renig on the chargeback. All the funds of 12dailypro.com's is now in the hands of a receiver after court proceedings involving the SEC.
We have to wait on word from the receiver about refunds.
I've gotten no refund yet. I'll let everyone know if I actually do, but I'm not holding my breath.

I received my chargeback that I started back in february last week. It was around $1,800 with providian bank.

I bank with bank of america and today i recieved a letter saying the investigation of my $1545 chargeback on stormpay was done with and I would get to keep the money!!! Had to wait since Febuary for them to do their investigation but its done with and Stormpay loses

It's been nearly 2 months since the SEC take over and I havn't gotten any information of substance from anywhere. If you e-mail the receiver, you get a regurgitated statement that basically says nothing except we're working on it. One obvious question that hasn't been addressed is, does Stormpay have the millions of dollars of 12Dailypros members money? If not, where is it? If the SEC's investigation hasn't come up with this money, why isn't there any criminal investigation and charges made against Stormpay. Here is the last reply from the SEC to my e-mail request. People must think we're all joking when we say it'll be years before anyone sees anything. If anyone sees anything before that then consider yourself lucky but it usually takes 2-3 years to work on these so they can drain every penny out for their 200-500 an hour they get to "receive" some account.

Charis Johnson, LifeClicks, LLC, and 12Daily Pro; USDC, Central Dist. of CA, Case No. CV 06-01018-NM(PLAx) As most of you know by now, on March 1, 2006, Judge Nora M. Manella of the United States District Court for the Central District of California entered an Order of Permanent Injunction and related Orders which included the appointment of Thomas F. Lennon as permanent receiver in the above-referenced case. This Permanent Injunction specifically enjoined investors from exercising self-help, including "initiating or processing chargebacks of any monies used to purchase or upgrade membership units in or with 12DP." Because the Permanent Injunction was not clear as to whether it also applied to financial institutions processing chargebacks, the Receiver sought and obtained the Clarification Order that explicitly also prohibited financial institutions, to the extent possible, from processing chargebacks or refunds on electronic transfers. The Clarification Order was entered March 14, 2006. Visa, MasterCard, Global Payments, and Nova Information Systems, Inc. all filed applications requesting that the Clarification Order be vacated and that the Permanent Injunction Order be narrowed to make clear that individuals that used their credit cards to purchase memberships or upgrades retained whatever rights they had under their agreements with their credit card issuer. These applications were granted by the Court's minute order dated March 27, 2006. The original Permanent Injunction and the Court's minute order are posted on the Receiver's website: www.tlennonfor12dailypro.com. As a result of these orders, investors who used credit cards to invest are not enjoined from exercising self-help vis-à-vis their credit card, but investors that used electronic fund transfers to invest are enjoined from exercising self-help. Although this may seem like an unfair distinction, the legal rights of each group are different. The rights of consumers to dispute electronic transfers are limited to unauthorized debits or errors in the amount of debits, but do not provide a right to reverse a transfer because the consumer has discovered that the recipient was perpetrating a fraud. Moreover, all investors and creditors are enjoined from initiating any legal action against 12Daily Pro, LifeClicks or Charis Johnson. The Receiver's goal is to try and put all investors on the same footing in obtaining a return of their principal. It is uncertain at this time whether there will be enough funds recovered to achieve that goal. The Receiver's efforts are focused on recovering funds that rightfully belong to the receivership estate, obtaining records from StormPay and others in order to determine how much each investor transferred to 12Daily Pro, how much each investor received in returns, and how much each investor recovered through chargebacks or electronic transfer returns. From this information, the Receiver will determine the net claim amount of each investor. The Receiver anticipates asking permission from the Court to distribute the assets recovered to investors pro rata based on net claim amounts. It is impossible to estimate at this time what likely recoveries will be or when the Receiver may be in a position to make distributions. The Receiver realizes that this is an extremely frustrating situation for investors, but please understand that he is working as diligently as possible to reach a fair and equitable result. i also got this email... i feel like its almost a threat.. what i don't understand is that i didn't have any money in 12dp and my chargeback wasn't made toward 12dp.. it was made for alientrust... so that does that put me in the scope for legal action.. im a bit confused
