A lawyer can only ADVISE. There is nothing they can do to absolutly PREVENT her from attending short of imprisioning her, and that would be illegal for her lawyers to do. Let's stop speculating and just see if she shows up?

True but she's never struck me as stupid. If she's got a snowball's chance in hell of winning this case, she'll listen to her lawyers.

At this point showing up would be the dumbest idea ever.

I personally don't know if she'll show up or not. Her actions these past few weeks haven't exactly been those of a really smart woman. She's shown she's got a lot of character, but character < smarts.

It wouldn't surprise me if she shows up, it would just be dumb.

Former Texas, NFL player sentenced in fraud case

Russell Erxleben, the former Texas and NFL kicker, was sentenced to seven years in federal prison Monday for bilking investors out of some $50 million.

Erxleben, 43, selected in the first round of the 1979 NFL draft by New Orleans, pleaded guilty in November 1999 to conspiracy and securities fraud involving hundreds of investors in his Austin Forex International, which traded in foreign currency.

According to investigators, Erxleben used his status as a former Texas and NFL player to attract investors. In addition to trading losses, funds invested in Austin Forex were given to earlier investors as false profits while other funds were spent on luxury office space, luxury cars, entertainment and travel.

About 800 investors lost $50 million in Austin Forex International.
Some had invested their life savings, believing the promises of huge returns. Many said they received statements that showed them making money, and that they had no idea they were losing money until the company abruptly closed its office.

U.S. District Judge James Nowlin also fined Erxleben $1 million and ordered him to pay $28 million in restitution.

In sentencing Erxleben, Nowlin dismissed pleas from the parents of the youth football team Erxleben helps coach to delay sentencing until the season is over.

As I recall, in the previous stormpay/tym global problem it was for similar thing and all they got was the cease and desist order. I don't recall any mention of fines even in the legal order that has been posted and linked to so many times before.




Right after that offer was made, as well as one by another attorney, Charis made a statement in the 12dp forum, that she could not accept those offers as they would be a conflict of interest (I believe that it was stated that they were both 12dp members).

I would jump straight in, but remove profits quickly too. she would almost be guaranteed her 300 000 members again. P.S. I think she is a scam but a very smart scam

Some of you said that venture capitalism does require a license, and others said that it doesnt, as long as the people who are putting in money know that their money isnt an 'investment' but rather a 'membership fee.' OK thats fair enough, but in Charis' case, she never blatantly said that she was investing our money in the Stock Market or securities, for example. I know the site said they generate revenue to pay out members from incoming member upgrades as well as outside investments, but you could read into that word 'investments' any way you like. I know a guy and him and a couple of his friends are basically independent consultants who pool together funds and put them into projects such as real estate development, formulating business ideas, etc. So whats the deal with Skunkpay guys; this is a new development that they are bringing up, the whole 'investigation into whether Charis had a securities license.' I feel that they added this to save face; they are going to look very stupid if in fact she was running a ponzi because they did business with her for over 10 months! How long does it take to get a clue that your BIGGEST client since Fall 2005 as shown by the Alexa traffic rating graphs is running something illegit?

Your right, this is all really just confusing and a headache to think about. I would hope that former senator does help against scampay for the sake of us members. I know alot of the people that upgraded with SP are able to do chargebacks, but theres alot of people who dont have access to these boards that I personally know and Im sure you all do too that are in a sticky because their pending payments from Egold to SP compounded...what do we say to these people? Oh you cant claim against SP? It just doesnt make any sense to me; my own referral was paid to her SP account by 12dp for an Egold to SP compounded pending payment hours before SP took it upon themselves to deny Charis access to her funds. Knowing that alone, I feel there should be something said for people in that particular boat...

It is not any of SP's business to decide anything about securities licenses....they are full of crap\1 If they were going to worry about such things they would have asked up front before they allowed her to use SP, instead they waited until there was so much money involved then reversed transactions from so many people and differnt companies it would be hard to prove whose money was whose~ If there was someone involved it would have been at the beginning and all the crap you keep seeing with chargebacks, well you wouldnt see them until it was over@!

To All Convention Attendees:

I wanted to take this time to send you all a message updating you on the status of the convention. Due to recent events of which everyone is aware, we have been unable to keep you updated on the event as often as we normally would have. We are operating on a skeleton staff and are doing the best we can. I want to thank you all for being patient during challenging time.

Firstly, I want to explain to you the reasons we are going ahead with the convention in order to dispel any misunderstandings. We know that this is a difficult time and that many of you may be negatively affected by what has occurred over the past few weeks. In no way are we or would minimize that fact. Quite the opposite. We know what you are going through because we are going through it with you. We await answers with you. We await action with you. We await resolution with you. Right now the attorneys and the investigators are in control (ours working feverishly on drafting our legal action) and we do anticipate light at the end of the tunnel, but we can't be for sure when.

This convention is not a party. It is not a celebration. We are not trying to forget or ignore what is happening. But this convention was never supposed to be about 12daily Pro. The fact is that this convention was always to be a gathering of internet marketing professionals who want to be learn and be motivated. What has happened has not changed that. I take that back. Something has changed. Now I feel even more a responsibility to provide that opportunity for you all. So, we plan on going forward with the weekend, but with an understandable tone of respect for what has transpired.

You should all know that the costs for this convention were planned and paid for in advance. Given our prior arrangements with hotels, vendors, registrants, etc., it would have ended up costing the company more cancellation fees, refunds, and reimbursements to cancel the event than to go forward with it. Also, not having this convention, would imply that we have something to hide or a reason to lie down and give up. That could not be further from the truth. Many of you have also expressed your desire to come and support LifeClicks during this time. We have been deeply touched by your responses.

There will be a few programming changes for the event, but we feel the changes will better reflect our current situation. We plan on a town meeting style session on Friday evening, in which we will give registrants the chance to speak and reflect on current issues. We feel ignoring what is happening would be inappropriate, so this will be the one session of the weekend that will address these issues. Saturday will be a day of motivation, learning, and brainstorming, culminating with our dynamic keynote speaker. Sunday morning will a time for looking ahead to what the future holds.

A few other notes…1) We will be sending out a more detailed schedule by the middle of next week. 2)We will be contacting booth vendors and volunteers by phone next week to solidify plans. 3)In addition to the above changes, know that we have taken the responsibility to acquire additional security for the event in the form of several off-duty police offers who will insure a peaceful and productive weekend for us all.

I've considered my 4K lost and have moved on... Do chargeback while you can and thats the only way we could see some of our money back...

Last Friday my bank had made a purchase adjustment (reversal) to the ScumPay transaction...
Still can't be sure until the dispute process is over. So I'd have to consider my money lost till I'm sure I have won. ScumPay !!

Anybody here going to the convention? I'm a 6 hour drive away, wondering if it would be worth it.

They never converted EMO funds into anything, lol...where did you ever get that idea? Charis has stated repeatedly that she'd funded SP based on expectations that most people would chose SP for their transitional upgrades from Egold...however, a lot more people than expected chose EMO instead, leaving Charis having put too much money in the wrong processor. It was when she tried to withdraw some funds from SP and move it over to EMO that SP froze the account.

If you read Charis's letter to those attending the convention, a couple posts back, you'll notice that she paid the bills for the convention in ADVANCE. Now think about it....If Charis paid for the convention ahead as stated, and she told us from the start that part of the frozen funds included the fees paid by attendees to the convention, how do you suppose she paid for the convention upfront? If they had no offline funds working for the business anywhere, how do you suppose one comes up with enough money to pre-pay a convention for 500 people?

Something else to think about...with no new upgrades for her to make earnings from, how do you suppose it is that 12DP has been able to make a few EMO payments to people, despite all that's been going on?

It is obvious to me that there was, and hopefully still is, a reserve of funds out there working and earning on behalf of 12DP. It's also obvious that 12DP, the company, is going to need to preserve that and make it grow in order to earn enough to make refunds after SP is finished with all their fees from moving all this money around, on top of all the chargeback fees 12DP has incurred from all this, not to mention the mounting legal fees.

Whats there to jeopardize? If Sp stole her money then there is nothing that she can say that may JEOPARDIZE the case. Its open and shut now if she has things to hid that may affect HERSELF that is more likely. So dont buy into that garbage about keeping quiet so it wont harm the case against SP.
