This is my first post so please be gentle with me. I am a member of 12daily just like the rest of you. I also stand to lose 6k. I actually should now say, that I have lost the 6k, since in reality, we are never going to see this money. I have already written this money off as my first loss for 2006. I have read through many posts on quite a few forums and I still have several nagging questions about this whole fiasco. I am a New Yorker born and raised and we are true skeptics by nature. The things that are nagging me are first and foremost, why did 12daily not serve Stormpay with an immediate cease and decist order the day Stormpay froze the account. If you have lawyers on retainer, that should have been the first course of action that was taken. This would have at least bought some time for 12daily. The second thing that really bothers me is, why did Charis not get on a jet with her lawyer on monday or tuesday and go and talk in person to the owner of Stormpay. I know that if someone was holding millions of my dollars hostage. I would not be wasting time with telephone calls and Emails. This should have been handled in person. Third, The news report that went out in Utah had no national coverage. This was simply an abc affiliate in butt **** Utah. This was not something that was picked up by abc news here in New York. You did not see this on CNN, this was not carried in any of the major newspapers. So the damage to the program from this was minimal. The thing that bothers me is, why charis did not attempt to make a statement to them and express her views. Then last thing that bothers me is the way people are handling this. We have members calling the attorney general in tennessee, we have members reporting Stormpay to the FTC. I have seen posts where members are looking to go to the FBI internet fraud division. I even saw one post about the CIA lol. The only agency left out is the Secret Service who would probably be the right division of law enforcement to handle this or the justice dept. The thing everyone is failing to realise is if any of these agencys get involved, It would be years before anything is finalised. The end result would still be the same, we would end up with nothing. The other small matter is all of this could push Stormpay into Bankruptcy, if that happens the money will surely be gone. We all know the enron and worldcom outcomes. I think the focus at this point should be, how do we help Charis rebuild the program, I think everyone needs to relax and take a deep breath. The only way this can be handled is legally, let the lawyers do their job and lets hope for the best.

However, there are many types of retainers. When a attorney or legal assistant uses the term retainer, it could mean a retainer for general representation, a case retainer, pure retainer, or a cash advance. In addition, all retainers fees are either earned or unearned. I could expand more on retainer fees, but I chose not to. I just want to you all to have a little knowledge of the legal world. 80% of attoney charges their client a retainer fee and uses a hourly rate fee for their services. If you had heard the term billable hour, that comes from the hourly rate fee set in the Legal Fee Agreement. You can think a retainer as a deposit. It most benefical the to attorney to use the hourly rate fee, b/c most cases take 6 months to years. The attorney is going to want to be paid for every document drafted, every copy made, bascially anything and everying pertaining to the client's case. After the case is closed, then the client is responsible for all expenses that incurred in their case. You may say,"Okay, I get it what's the point?" Here is the point if Charis had retain attorney before the fact, most likely their services was already set on a hourly rate fee. If Charis retained a attorney after the fact then most likely there is an retainer that she must pay, and also the hourly rate that she responsible for after the case closes. Either way there should be little to none out of pocket exspenses she will pay up front. I doubt that this Charis woman is broke, surely she has her own personal bank account that she can use for the retainer. And the hourly fee at the end can be paid in monthy installments. If a client can not pay, the attorney simply gets an attorney's lien. All I'm saying is before you start donate money to this woman, it is best to find out more. I not saying that she is trying to scam any of you, only that maybe she never had an attorney in the first place. There is no reason why the attorney would her stop for making any public announments if her record is clean, he/she would advise her to do so. But if she has went into this with dirty hands it would be wise, if she did not say anything that could damage her case. When I heard that she would accept donations, something tells me that there is more going on that she is willing to tell. It's too early in the game to say who all is at fault, and there is too much information missing for ppl to give their complete trust and dedication to Charis, regardless how much money individuals earned. I just spent 15 minutes on the phone with Michael Rose, and he sounds like a highly intelligent man who is willing to help. He is also an investor in 12dailypro and a user of Stormpay. Right now he neutral and feels that he cannot come to any conclusion as to blame for the recent events. This was simply an abc affiliate in butt **** Utah. This was not something that was picked up by abc news here in New York. You did not see this on CNN, this was not carried in any of the major newspapers. So the damage to the program from this was minimal. The thing that bothers me is, why charis did not attempt to make a statement to them and express her views. This was a local Utah report but it has worldwide coverage on the internet. Even Stormpay was using the abc4 link in thier responses to members today! It doesnt matter where teh report was from, it was wrong, and thier references are incomplete and incorrect and that is not acceptible of any news source anywhere! The BYU article was hysterical. I am a college student and If I were to write something like that it would come back with an F and would never be published online for anyone to read with no facts checked, statements made about 12dp site saying it was in singapore, words misspelled, seriously people need to be accountable for what they tell the public. if they are going to say something damaging to somone they better darn sure have thier facts straight or at least verifiable! I know that if someone was holding millions of my dollars hostage. I would not be wasting time with telephone calls and Emails. This should have been handled in person. We have members calling the attorney general in tennessee, we have members reporting Stormpay to the FTC. I have seen posts where members are looking to go to the FBI internet fraud division. I even saw one post about the CIA lol. The only agency left out is the Secret Service who would probably be the right division of law enforcement to handle this or the justice dept. The thing everyone is failing to realise is if any of these agencys get involved, It would be years before anything is finalised. The end result would still be the same, we would end up with nothing. The other small matter is all of this could push Stormpay into Bankruptcy, if that happens the money will surely be gone. We all know the enron and worldcom outcomes. I think the focus at this point should be, how do we help Charis rebuild the program, I think everyone needs to relax and take a deep breath. The only way this can be handled is legally, let the lawyers do their job and lets hope for the best. is there a chance that we are seeing our money again or at least a refund? why people are so in low hope now?
